DWI Process
Most people are extremely afraid of the thought of a DWI on their record and may panic when pulled over or accused of this act. The DWI process, in most cases, is as follows:
- The Pull Over- A police officer must have a reason to pull over a driver. For example, if they run a light, are caught speeding, or are exhibiting reckless driving practices, the officer has the right to perform a routine traffic stop.
- The Investigation- During this search, if the police officer begins to suspect that the driver has consumed a considerable amount of alcohol, they may decide to conduct a DWI investigation. This will include gathering proof that the individual is operating his or her vehicle while over the legal limit.
- Sobriety Tests- In order to obtain proof that a driver has a blood alcohol content over the legal limit, the officer will ask the individual to perform one or multiple field sobriety tests. These may include several physical tasks designed to prove intoxication, a blood test, and / or a breathalyzer test.
- The Arrest- A failure to complete a field sobriety test correctly, or a refusal to take one, may result in a request for further proof, or the police officer may decide to arrest the individual.
