Divorce from Bed and Board

In North Carolina, divorce is not a simple thing to obtain. What most individuals consider when they think of divorce is actually known as absolute divorce in North Carolina, and requires lengthy separation periods in order to be granted. Divorce from bed and board, on the other hand, is often a fairly quick action, forcing one party out of the marital residence on the basis of some fault-based action.

Divorce from bed and board, unlike absolute divorce, does not entirely end the marital relation. Rather, it enforces a separation between the two parties by requiring one spouse to leave the marital home. Furthermore, the spouse found to be at fault typically loses certain other rights, including most property rights relating to the other spouse.

Causes of Fault

In order to be able to successfully apply for a divorce from bed and board, a married individual must first demonstrate that their spouse has engaged in at least one of the following activities:

  • Family abandonment
  • Turning one’s spouse “out of doors” maliciously
  • Excessively cruel treatment
  • Causing considerable indignities to the other spouse
  • Excessive use of drugs or alcohol
  • Adultery

Any of these behaviors may be enough to demonstrate fault in an application for divorce from bed and board.
